फिलहाल पूरे देश में 69K शिक्षक भर्ती एक ज्वलंत मुद्दा बना हुआ है वजह जो भी हो अभ्यर्थियों की पीड़ा समझी जा सकती है

ऑनलाइन फार्म भरने में हुई गलती को मानवीय भूल व कम्प्यूटर आपरेटर की गलती मानने से इनकार कर दिया है।कोर्ट ने कहा कि गलती मानवीय भूल नही है। फार्म भरते समय निर्देशों का पालन करना अनिवार्य है।
याचिकाकर्ताओं को दिए गए निर्देश ध्यान से पढ़ने चाहिए थे और पूर्व की परीक्षाओं में प्राप्त अंकों के संबंध में प्रविष्टियों को सही से भरना चाहिए था.” अदालत ने कहा, “यह दलील कि यह ऐसी गलती थी जो कंप्यूटर आपरेटर द्वारा की गई, स्वीकार्य नहीं है. कोर्ट ने कहा यदि अदालतें इस तरह की याचिकाएं स्वीकार करने लगें तो इससे ऐसी स्थिति उत्पन्न हो जाएगी जहां याचियों को गलत चीज का लाभ मिलने लगेगा।
कोर्ट ने यह भी कहा कि जिसने गलती की है उसे उसका परिणाम भुगतने के लिए तैयार रहना चाहिए । यह आदेश न्यायमूर्ति प्रकाश पाडिया ने आशुतोष कुमार श्रीवास्तव व अन्य की याचिका पर दिया है ।
उल्लेखनीय है कि इन याचियों ने सहायक अध्यापक परीक्षा के लिए आवेदन किया था और वे छह जनवरी, 2019 को इस परीक्षा में शामिल हुए जिसका परिणाम 12 मई, 2020 को घोषित किया गया जिसमें क्वालिफाइंग अंक हासिल करने वाले सभी याचिकाकर्ता पात्र घोषित किए गए. इन याचिकाकर्ताओं ने बीएड के अंक भरने के संबंध में गलती कर दी।
याचियों के वकील ने दलील दी थी कि यह गलती केवल मानवीय भूल है, लेकिन अदालत ने यह दलील स्वीकार नहीं की। कोर्ट ने इस मांग को भी यह कहते हुए खारिज कर दिया कि याचियो के परीक्षा नियामक प्राधिकारी को दिये गये प्रत्यावेदन को निर्णीत करने का निर्देश दिया जाये।
कोर्ट ने कहा कि बहस के लिए एक और खिड़की नही खोली जा सकती। कोर्ट ने याचिका पर कोई राहत देने से इंकार कर दिया।

The instructions given to the petitioners should have been read carefully and the entries should have been filled correctly with respect to the marks obtained in the previous examinations. ” The court said, "The argument that this was a mistake made by a computer operator is not acceptable. The court said that if the courts start accepting such petitions, then a situation will arise where the petitioners will get the benefit of the wrong thing.
The court also said that anyone who committed a mistake should be prepared to bear the consequences. This order has been given by Justice Prakash Padiya on the petition of Ashutosh Kumar Srivastava and others.
It is noteworthy that these petitioners applied for the Assistant Teacher Examination and they appeared in this examination on January 6, 2019, the result of which was declared on May 12, 2020, in which all the petitioners scoring qualifying marks were declared eligible. These petitioners made a mistake regarding filling the marks of B.Ed.
The petitioners' counsel had argued that the mistake was a mere human error, but the court did not accept this argument. The court also rejected this demand, saying that the examination regulatory authority of the petitioners should be directed to decide the representation given.
The court said that another window could not be opened for debate. The court refused to grant any relief on the petition.
